Terms of service
Terms and Conditions (T&Cs)
1. Scope
These Terms and Conditions (T&Cs) apply to all orders placed by consumers (§ 13 German Civil Code) and businesses (§ 14 German Civil Code) via the hejmarla online shop.
Contract partner:
hejmarla
Sarah Egerer
Autharistraße 43
81545 Munich
Germany
Email: shophejmarla@mail.com
Any deviating terms of the customer shall not be recognized unless expressly agreed to in writing.
2. Conclusion of Contract
The presentation of products in the online shop does not constitute a legally binding offer, but a non-binding invitation to place an order.
By clicking the order button, you submit a binding offer to purchase the goods contained in the shopping cart.
Confirmation of receipt of your order is sent by email immediately after submission and does not yet constitute acceptance of the contract.
A contract is only concluded when we expressly accept your order by a separate confirmation email or dispatch the goods.
3. Prices and Payment Terms
All prices are final prices and include applicable VAT.
For deliveries outside the European Union, goods are supplied without German VAT. Any customs duties, taxes, or import charges shall be borne by the customer.
The available payment methods are displayed during the order process. The purchase price is due immediately upon conclusion of the contract.
4. Delivery and Shipping
Delivery is made worldwide using selected shipping service providers to the address specified by the customer.
Unless otherwise stated, delivery time is up to 14 days. The delivery time stated on the respective product page shall apply.
For custom-made or “made to order” products, delivery times may be extended accordingly.
If a product is unavailable, we will inform you without undue delay.
5. Retention of Title
The goods remain our property until full payment has been received.
6. Right of Withdrawal
Consumers are entitled to the statutory right of withdrawal.
You have the right to withdraw from this contract within 14 days without giving any reason. The withdrawal period begins on the day you, or a third party designated by you, take possession of the goods.
To exercise your right of withdrawal, it is sufficient to send a clear statement by email to:
shophejmarla@gmail.com
7. Consequences of Withdrawal
In the event of a valid withdrawal, we will refund all payments received, including delivery costs (except for additional costs arising if you chose a delivery method other than the standard delivery offered by us), without undue delay and no later than 14 days from the day we receive the returned goods.
Refunds will be made using the same payment method used in the original transaction, unless otherwise agreed.
You bear the direct cost of returning the goods.
We may withhold the refund until we have received the goods back or you have provided proof that you have returned the goods.
8. Exclusion of the Right of Withdrawal
The right of withdrawal does not apply to contracts for:
- goods that are not prefabricated and for which an individual selection or determination by the consumer is decisive
- personalized or custom-made jewelry pieces
- “made to order” products
9. Exchanges (Voluntary Service)
Exchanges are granted on a voluntary basis only and without legal entitlement. Items must be returned unworn, undamaged, and in their original packaging.
Personalized and “made to order” products are excluded from exchange.
10. Warranty and Liability
Statutory warranty rights apply.
hejmarla shall be liable without limitation in cases of intent and gross negligence, as well as for damages resulting from injury to life, body, or health.
In cases of slight negligence, liability is limited to foreseeable, typical contractual damages if essential contractual obligations are breached.
Any further liability is excluded.
In particular, no liability is assumed for damages caused by improper use, normal wear and tear, or failure to follow care instructions.
11. Product Information
Our jewelry is handmade and made from natural materials. Variations in shape, color, and texture are inherent to the production process and do not constitute defects.
The products are not toys and are not suitable for children.
To avoid damage, jewelry should be removed before contact with water, perfume, cosmetics, or during sports activities.
12. Electronic Communication
Communication regarding order processing takes place via email or, where applicable, SMS (e.g. order confirmation, shipping updates).
If you have subscribed to our newsletter, you will receive information about offers and updates. You may unsubscribe at any time.
13. External Content and Social Media
Our website may include content and functions from third-party providers (e.g. Pinterest, Instagram). When accessing such content, data may be transmitted to these providers.
Further information can be found in our privacy policy.
14. Final Provisions
Should any provision of these T&Cs be wholly or partially invalid, the validity of the remaining provisions shall remain unaffected.
The law of the Federal Republic of Germany shall apply, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).
If the customer is a merchant, the place of jurisdiction shall be Munich.
